Legal status of professionals under the sway of The New Romanian Civil Code

The entry into force of the New Romanian Civil Code brought renewed attention to the autonomy of commercial law and the legal status of professionals. This article examines the concept of the professional and the exploitation of an enterprise, as well as the effects of the unification of private law on institutions traditionally associated with commercial relationships. It analyses the changes concerning joint and several liability of co-debtors, interest, default, place of performance and determination of price. The discussion highlights the continuing distinct characteristics of commercial law despite the unified framework introduced by the New Civil Code.
